01 Acceptance of Terms

By accessing or using the BotanicRain website at botanicrain.co (the "Site") or placing an order with us, you agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully before using the Site or making a purchase. If you do not agree with any part of these Terms, please do not use the Site.

These Terms apply to all visitors, users, and customers of BotanicRain ("BotanicRain," "we," "us," or "our").

02 Eligibility

You must be at least 18 years of age to use this Site or place an order. By using the Site, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding agreement. We do not knowingly collect information from individuals under 18.

03 Products & Descriptions

Accuracy of descriptions

We make every effort to display product descriptions, ingredient lists, and images as accurately as possible. However, we do not warrant that product descriptions or other content on the Site are complete, reliable, current, or error-free. If you receive a product that is materially different from its description, please contact us and we will make it right.

Not medical advice

BotanicRain products are cosmetic products intended for external use only. Nothing on the Site constitutes medical advice, diagnosis, or treatment. Our Dosha quiz and skincare recommendations are general wellness guidance, not medical advice. If you have a skin condition, allergy, or medical concern, consult a qualified healthcare professional before use.

Availability

All products are subject to availability. We reserve the right to discontinue any product at any time. In the event a product is unavailable after your order is placed, we will notify you and issue a full refund to your original payment method.

04 Orders & Payment

Order acceptance

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order for any reason, including errors in product or pricing information. Your order is accepted when we send you a shipping confirmation.

Pricing

All prices are listed in US dollars and are subject to change without notice. We make every effort to ensure pricing accuracy. In the event of a pricing error, we will contact you before processing your order and give you the option to proceed at the correct price or cancel.

Payment

We accept all major credit cards and other payment methods displayed at checkout. By submitting your payment details, you represent that you are authorised to use the payment method and that the information you provide is accurate and complete.

Subscriptions

If you purchase a subscription, your payment method will be charged automatically on a recurring basis at the frequency selected (currently every 45 days). You may skip, pause, or cancel your subscription at any time through your account or by contacting us at hello@botanicrain.co. Cancellations made before the next billing date will take effect immediately.

05 Shipping & Delivery

Orders are shipped within the United States via Amazon's fulfilment network. Estimated delivery times are provided at checkout and are not guaranteed. BotanicRain is not responsible for delays caused by carriers, weather, or circumstances beyond our control.

Title and risk of loss pass to you upon delivery of your order to the carrier. For full shipping details, please see our Shipping & Returns page.

06 Returns & Refunds

We offer a 30-day no-questions-asked refund policy. If you are not satisfied with your purchase for any reason within 30 days of delivery, contact us at hello@botanicrain.co with your order number and we will issue a full refund. You do not need to return the product.

Refund requests made more than 30 days after delivery are not eligible. For purchases made through third-party retailers (including Amazon), please contact the retailer directly.

07 Intellectual Property

All content on the Site — including text, images, graphics, logos, product names, the BotanicRain name and mark, and the overall look and feel of the Site — is the property of BotanicRain or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, display, or use any content from the Site without our prior written permission, except for personal, non-commercial use. Any unauthorised use may violate copyright, trademark, or other laws.

08 Prohibited Conduct

When using our Site, you agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to gain unauthorised access to any part of the Site, its servers, or systems
• Transmit viruses, malware, or other harmful code
• Scrape, copy, or harvest content from the Site without permission
• Submit false or misleading information in connection with a purchase or account
• Impersonate BotanicRain or any person or entity
• Engage in any conduct that restricts or inhibits others' use of the Site

We reserve the right to terminate access to the Site for any user who violates these Terms.

09 Disclaimers

The Site and its content are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that the results obtained from use of the Site will be accurate or reliable.

Individual results from using BotanicRain products may vary. Testimonials and reviews reflect the experiences of specific customers and are not necessarily representative of results others will achieve.

10 Limitation of Liability

To the fullest extent permitted by applicable law, BotanicRain, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products, including but not limited to loss of profits, data, or goodwill.

In no event shall our total liability to you for any claim arising from your use of the Site or our products exceed the amount you paid for the specific product(s) giving rise to the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

11 Indemnification

You agree to indemnify, defend, and hold harmless BotanicRain and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, penalties, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any third-party rights.

12 Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the Site will be resolved through binding individual arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for claims involving intellectual property. You waive any right to participate in a class action lawsuit or class-wide arbitration.
